The OAIC expects evidence, not intent, so agencies have roughly seven months to operationalise compliance.

The mechanics are simple to recite and harder to deliver. The Privacy and Other Legislation Amendment Act 2024 received Royal Assent on 10 December 2024. It introduced new APP 1.7 obligations for automated decision making and gave organisations a 24 month commencement window. The clock has been running since the day the Act passed; we are now seven months from go live.

What counts as ADM in recruitment under the reformed Act

The Act captures two limbs. First, decisions made solely by the operation of a computer program. Second, decisions for which a computer program does something substantially and directly related to making a decision, where the decision could reasonably be expected to significantly affect the rights or interests of an individual. Both limbs land in recruitment. The second limb is where most agencies will sit.

Sourcing, screening, ranking, scheduling: where ADM bites

A keyword search across an ATS does not trigger the regime on its own. An AI score that surfaces ten candidates from a hundred almost always does, because that score shapes which applicants the recruiter then reviews. Automated rejection emails based on a model output are inside the regime. Automated calendar invites that follow a model decision are inside the regime. A model that recommends a salary band based on candidate features is inside the regime. The recruiter, not the recruiter’s tooling, is on the hook.

The APP 1.7 threshold most agencies miss

Many agencies still read the Act as if it imports GDPR’s narrow “solely automated” standard. It does not. The Australian regime is broader. If a recruiter clicks “approve” on a list of ten names the AI selected, the AI’s contribution is “substantially and directly related to making the decision” even though a human applied the final click. That breadth is intentional. Government explanatory materials list “employment opportunities, including recruitment, promotion or termination” among the decisions that significantly affect rights or interests.

The seven month operational roadmap

Treat this as four tranches inside the same project. The intent is that an agency can run all four in parallel, with the privacy officer or general counsel owning the evidence pack, and the head of talent or head of recruiting owning the operational work.

Months 1 to 2: ADM register and data flow mapping

  • List every system that scores, ranks, sorts or filters candidates: ATS native scoring, sourcing platforms, AI shortlisters, internal LLM pipelines, scheduling bots.
  • For each system, capture: the personal information inputs, the decision class output, the recruiter step that consumes the output, and the typical effect on the candidate (rejection, advancement, ranking).
  • Cross check the inventory against the existing FluxHire Australian Privacy Principles compliance checklist. Any APP 1 disclosures still rooted in 2024 language need rewriting.
  • Output of this tranche: a board ready ADM register that names every tool, every decision class, and every recruiter who can override the output.

Months 3 to 4: PIAs, transparency notices and candidate facing disclosures

  • Run a Privacy Impact Assessment on every substantial ADM use. Identify foreseeable harms, mitigations, and the data minimisation steps already in place.
  • Draft the new APP 1 transparency block. It must state the kinds of personal information used, the kinds of decisions made solely by a program, and the kinds of decisions where programs play a substantially direct role.
  • Update candidate facing collection notices: the application form, the careers page, the recruiter outreach signature. Plain English mirroring the privacy policy, with a link to the policy itself.
  • Brief client portfolios (for agencies) and hiring managers (for in-house). Their privacy policies are also captured; the recruiter is downstream of their data controller responsibilities.

Months 5 to 6: Human oversight controls and override logging

  • Wire approval steps into every consequential automation. No automated rejection, no automated outreach, no automated salary recommendation can leave the platform without a named human approver.
  • Log every override of an AI score. The audit trail must answer: which recruiter, which candidate, which model version, why.
  • Train every recruiter on the new workflow. The training record is part of the OAIC’s reasonable steps test.
  • Decide the operational definition of “substantially direct role” for your context, and write it down. Reasonable line drawing, defended in advance, beats post hoc justification.

Month 7: Audit, evidence pack and board sign off

  • Independent audit of the ADM register, PIAs, notices, and override logs. Most agencies will use their existing privacy counsel; large agencies will bring in a Big Four privacy team.
  • Evidence pack on a shared drive: register, PIAs, published privacy policy, candidate notices, override logs sample, training records, board minute.
  • Board level sign off. The minute should record that the directors have considered the ADM regime and are satisfied with the steps taken. This is the document the OAIC asks for first.

Drafting your OAIC aligned ADM transparency notice

The APP 1.7 disclosure does not need to expose how a model works. It needs to make clear what the model is used for, what data it sees, and what decisions it shapes. Plain language is the standard. The disclosure that survives audit is the one a non technical reader can understand on first read.

A workable template includes three blocks. Block one: the kinds of personal information your ADM programs use, listed in everyday terms (work history, qualifications, location, work rights, application content). Block two: the kinds of decisions the program makes solely, if any (auto rejection beyond a threshold, automated scheduling of phone screens). Block three: the kinds of decisions where the program plays a substantially direct role (shortlist surfacing, candidate ranking, suggested salary bands, recommended outreach order).

Keep a parallel internal version with the model names, vendor names, dataset descriptions and review cadence. The public notice does not require that depth. The OAIC will request it on audit.

Privacy Impact Assessments for AI sourcing and screening

A PIA is the document that ties the abstract APP 1 disclosure to the actual operational reality. For an AI shortlister, the PIA should cover six questions: what personal information goes in; what model output comes out; what decision the output drives; what foreseeable harms could result (bias, unfair exclusion, accuracy drift); what mitigations are in place (review, override, monitoring); and what monitoring is in place to detect drift after deployment.

The OAIC has not prescribed a PIA template for ADM. Several established Australian templates work. The simpler the document, the more likely it will be read, updated, and survive audit. Pair each PIA with a clearly named owner: the privacy officer signs off; the head of recruiting maintains it.

Human in the loop controls that satisfy reasonable steps

“Reasonable steps” is the standard the OAIC uses to assess compliance. For an AI hiring stack, reasonable steps means: a named human in the loop at every consequential point, an override mechanism that is used (not just available), a log that captures the override and its reason, and a feedback channel that lets the recruiter flag systematic issues with the model output.

The penalty grid recruiters should plan against

The three tier civil penalty regime introduced by the 2024 amendments matters for budget conversations. For serious interferences with privacy by a body corporate, penalties reach the greater of $50 million, three times the value of any benefit obtained, or 30 per cent of adjusted annual turnover. The Senate amendments removed “repeated” as a standalone trigger for the top tier; repeated interferences are caught by the mid tier instead. Mid tier interferences carry a maximum of approximately $3.3 million per contravention. Lower tier breaches, including failures to include required disclosures in an APP 1 privacy policy, can attract infringement notices of up to $62,600 for body corporates, in addition to court ordered civil penalties.

Penalty unit values are reset annually under section 4AA of the Crimes Act and the figure above reflects current settings. Recruiters running large desks should plan against the mid tier figure as the realistic exposure on a missed disclosure, not the headline $50 million.

Agency action plan for this quarter

For the rest of this quarter (May to July 2026), three concrete actions move the agency forward. One: appoint a named compliance owner for the ADM programme. The privacy officer in a large agency; the head of recruiting in a smaller one. Two: commission the ADM register and the first round of PIAs. Budget two weeks of an analyst’s time plus privacy counsel hours. Three: brief the board now, not in November. A board that has seen the timeline in May is a board that will fund the rest of the programme in July.
